CaseyGerry’s Gayle M. Blatt Appointed to Plaintiff’s Executive Committee in Apple Inc. Class Action Litigation

SAN DIEGO (May 22, 2018) Gayle M. Blatt — a partner at San Diego-based law firm CaseyGerry and head of its complex litigation practice group — has been appointed by U.S. District Judge Edward J. Davila of the Northern District of California to the Plaintiffs’ Executive Committee for In re: Apple Inc. Device Performance Litigation.

Centralized in the Northern District of California in April, this class action litigation stems from a January 2017 update Apple released for iOS, the operating system for iPhones. At the time the update was released, Apple said it “includes bug fixes and improves the security” of iPhones. However, testing revealed that the update also degraded the performance of older iPhones. While Apple ultimately acknowledged the January update intentionally slowed the performance of older phones, purportedly to preserve battery life, many consumers had already purchased replacement batteries or new phones. Blatt, along with the other appointed plaintiffs’ attorneys, will work to protect the interests of affected consumers and to obtain a just and speedy resolution of the case.

According to CaseyGerry’s managing partner David S. Casey, Jr., “this appointment reflects Gayle’s reputation among her peers and her commitment to consumer advocacy.” CaseyGerry attorneys also currently serve in court-appointed leadership roles in the Wells Fargo forced-placed insurance, NFL head injury, Volkswagen “Clean Diesel,” and Fiat Chrysler Eco Diesel litigation.

Blatt focuses her practice on complex and class litigation, including consumer protection, data privacy, and serious personal injury cases. In addition to her position in the Apple litigation, she serves on the five-person Plaintiffs’ Executive Committee in the Yahoo data breach litigation and as co-liaison counsel in the Incretin Mimetics multidistrict litigation.
