Lawsuit Filed on Behalf of Wrestler Seriously Injured at Camp Pendleton

CaseyGerry Files Lawsuit in Serious Personal Injury Case on Behalf of US National Team Athlete Richard Perry

San Diego, July 29, 2020 – San Diego based law firm CaseyGerry has filed a lawsuit in the U.S. District Court for the Southern District of California against the United States of America, product manufacturer Armament Systems and Procedures, Inc., and others on behalf of elite athlete and former wrestling US National Team member Richard Perry and his wife Gina Cimmino.

According to court documents, on August 27, 2018, Perry was at Marine Corps Base Camp Pendleton for a National Team training camp, when he suffered a catastrophic head injury after being placed into a “military weapons training exercise … with instruction to strike, thrust, and jab at the opponent’s head and face [with a baton] to score ‘a kill shot’ .…  Although the Marine Corps provided others with tight metal grid facemasks, it gave Richard Perry a plain football helmet and facemask with large openings over his eyes and face.”

CaseyGerry Partner, Robert J. Francavilla, the lead trial attorney on the case, said “Perry suffered a traumatic injury that has affected his life, his livelihood and the lives of those who love him. We intend to hold those responsible for this injury, accountable.”

The lawsuit maintains that “[t]he Marine Corps also gave Richard Perry’s training partner, another wrestler with no combat weapons experience, a defectively designed and manufactured …  baton that was unsafe for this activity and that had worn and ripped padding and parts.”

According the court document, “[d]uring the exercise, Richard Perry’s training partner jabbed forward with the baton and it passed through one of the large gaps in Perry’s football facemask. The baton’s thin hard central rod separated from its padding and penetrated the torn and deteriorated fabric covering, shattering Richard Perry’s eye socket and skull, and pushing the shattered bone fragments into his brain, causing catastrophic brain damage along with other life-altering injuries.”

Francavilla and associate Adam B. Levine are working together on this case to ensure Perry’s story is instrumental to avoiding future injuries like this.
