Business Insider-A new lawsuit could change how Amazon does business with 3rd-party sellers forever

CaseyGerry partner Jeremy Robinson recently spoke to Business Insider on McMillan v. Amazon.com and how it could change how Amazon and other e-tailers do business with third-party sellers. In McMillan v. Amazon, a nineteen-month old girl swallowed a battery to a remote control that was purchased on the Amazon marketplace. The family, unable to locate the seller, sued Amazon.com, who owns the marketplace platform.

The ecommerce giant has managed to avoid liability despite numerous suits. That is, until Bolger v. Amazon.com, in which plaintiff, Angela Bolger, who sustained serious burns as a result of an exploding laptop battery purchased from a third-party seller on Amazon, successfully appealed a previous ruling. Bolger was represented by CaseyGerry’s Jeremy K. Robinson, Thomas D. Luneau and Jillian F. Hayes.
