Settlement Reached in Off-road Vehicle Case

“The vehicle had been significantly modified.”

Scott Cummins, of Counsel with CaseyGerry, recently obtained a seven-figure settlement on behalf of a man who suffered catastrophic head injuries following a serious accident in a modified four wheel drive, off-road vehicle.

According to Cummins, his client was riding in the passenger seat of an off-road vehicle utilized to transport people and equipment. “The vehicle had been significantly modified,” Cummins explained.

“The cab frame/roll bar had been remove, and the side protection bars lowered in such a way that they no longer provided restraint for a passenger and did not permit attachment points for seatbelts.”

As the driver of the vehicle made a left turn, the client was thrown from the vehicle, hitting his head on the pavement and suffering a debilitating brain injury. The case was filed against both the client’s employer under Labor Code section 3706 and the manufacturer of the vehicle for negligence, design defect and strict products liability.
